El Peruano published Resolución de Secretaría de Gobierno y Transformación Digital N° 004-2026-PCM/SGTD on 21 October 2026. The resolution was signed in Lima on 19 October 2026. It approves Directiva N° 002-2026-PCM/SGTD, which sets the profile, appointment criteria and responsibilities of an Oficial de Inteligencia Artificial, an Artificial Intelligence Officer, in public entities. The resolution enters into force the day after its publication in El Peruano. Compliance with the officer profile in article 9 of the directive is enforceable 12 months after the resolution enters into force.

The directive is binding on public-administration entities in article I of the preliminary title of the single ordered text of Law 27444, except the legal persons in item 8 of that article, and on state business entities, including firms under FONAFE and the fund itself. The entities that appoint an officer include ministries and their attached bodies, autonomous constitutional bodies, the judiciary, Congress, FONAFE firms, public universities and public health providers of category II-2 or above, regional governments, and type A and type C municipalities as classified by the Ministry of Economy and Finance.

Article 11 counts the appointment deadlines from the day after publication of the directive in El Peruano. The maximum is not more than 6 months for ministries and the other national bodies in that table, not more than 9 months for regional governments and their business-treatment entities, and not more than 12 months for type A and type C municipalities and local public enterprises. Within 7 business days of the appointment, the entity's digital-government committee must tell the Secretariat of Government and Digital Transformation and register the officer. The officer is a public official or employee, reports to the entity's top administrative authority, and sits on that committee with a voice and a vote. The directive says the appointment does not require a new budgeted post unless the entity decides to create one. If an entity cannot appoint an officer, it sends the secretariat a technical report signed by the top administrative authority. That report does not remove the committee's responsibility for the AI rules.

What it means for business: the duty is on Peruvian public bodies, not on private companies. The directive does not print calendar end dates for the 6-, 9- and 12-month periods, so none are stated here. This describes the directive. It is not advice on a contract.
