Anthropic asks the D.C. Circuit to rehear the Pentagon supply-chain case
13 Oct 2026 · added 17 Oct 2026
On 13 October 2026 Anthropic filed a petition for panel rehearing or rehearing en banc in the D.C. Circuit (Nos. 26-1049 and 26-1162, document 2197902). The public docket lists that petition, entered the same day, and a clerk's order of 15 October 2026 directing a response by 30 October 2026. A divided panel decided on 25 September 2026 to uphold the Department of War's supply-chain-risk designation. The petition says the majority misread 41 U.S.C. § 4713, treated the bypass of the statute's procedures as harmless, and that the due-process holding conflicts with a Northern District of California finding that no exigency justified withholding a pre-designation process.
What it means for business: the designation stands unless the court grants rehearing.
