EU consults on AI Act penalty procedure rules

On 12 October 2026 the European Commission services published a draft implementing regulation, Ares(2026)9589403, on proceedings under Articles 75c and 75d of the AI Act. The draft says it has not been adopted. It covers access to the Commission's file, protection of business secrets, and five-year limitation periods for imposing and enforcing fines and periodic penalty payments.

What it means for business: these are draft rules for how some AI Act fines would be handled. The draft itself does not state a closing date for comments.
