8 Oct 2026 · added 19 Oct 2026
Italy published Legislative Decree No. 179 of 7 October 2026 in the Gazzetta Ufficiale (Serie Generale n. 234) on 8 October. It adapts Italian law to the EU AI Act (Regulation (EU) 2024/1689) on the powers of national authorities and the use of AI in training ("formazione"), and enters into force on 23 October 2026. Article 4 names AgID (Agenzia per l'Italia digitale) as the national notifying authority. Article 1 lists ACN (Agenzia per la cybersicurezza nazionale), Banca d'Italia, CONSOB, IVASS and the Garante per la protezione dei dati personali as national market-surveillance authorities, and names Banca d'Italia, CONSOB and IVASS as the financial-sector authorities. Article 5 limits the Garante's market-surveillance role to Article 74(8) of the AI Act.
What it means for business: companies providing or deploying AI systems in Italy will have named national regulators for AI Act notification and market surveillance from 23 October, with financial-sector AI supervised by the existing financial regulators.
